Listen carefully, because I'm about to defend something you hate and attack something you love, which is how you know this is an Op-Rat column and not a hug.

Axios reported that Democrats' midterm gains handed them the governorship and both legislative chambers in Pennsylvania, Michigan, Arizona, Wisconsin and Nevada. That's five new trifectas. The National Popular Vote Interstate Compact already has 18 states and Washington, D.C., totaling 222 electoral votes. Add those five and the math hits about 283. The compact only activates at 270. In other words: Democrats just unlocked the cheat code to make the Electoral College decorative.

They still have to pass it. Michigan failed to enact it during its last Democratic trifecta. Nevada's then-Democratic governor vetoed it in 2019 because he worried it would shrink his state's influence. Notre Dame law professor Derek Muller says it may need congressional approval under the Compact Clause. So this is not finished. It is merely loaded.

Here is where I lose both rooms. Republicans who spent two years calling every election "rigged" are about to discover what a real structural rewrite looks like, and Democrats who spent two years calling the Electoral College racist are about to discover they can scrap it without a constitutional amendment, a convention or a single swing-state stump speech in Ohio. Democracy, redefined as "we finally have the statehouses."

The Constitution lets each state appoint electors "in such Manner as the Legislature thereof may direct." That sentence is the entire game. Under the compact, participating states would award their electors to the national popular-vote winner once the 270 threshold is met. The Electoral College stays on the building. The wiring gets swapped. It's the political equivalent of keeping the restaurant name while changing the kitchen, the menu and the locks.

You want to yell that this is unfair to small states? Fine. Yell. Also notice that the same party that just ran on grocery prices is already shopping for a permanent presidential map that runs through California, New York and Illinois and treats Wyoming like a rounding error. Affordability on Tuesday. Cartography on Thursday. Priorities.

Crow's advice to both sides: stop pretending this is about "every vote counting." It's about which votes count twice. Republicans clung to the Electoral College when it saved them. Democrats are sprinting toward the compact now that the trifectas landed in their lap. Principles that only appear after the Associated Press calls a race are not principles. They're receipts.

So watch Pennsylvania. Watch Michigan. Watch Arizona, Wisconsin and Nevada. If those legislatures join, 2028 will not be an election under the rules your civics teacher described. It will be an election under the rules the winners wrote while the losers were still refreshing county dashboards. That is not a conspiracy. That is a calendar.
